Worker Agreement

HOMZapp Sign Post Worker Agreement

Effective Date: July 2, 2026

This Worker Agreement ("Agreement") is entered into between Qlukapp, operating the HOMZappplatform ("HOMZapp", "we", "our", or "us"), and the individual or business registering as a service provider ("Worker", "you", or "your").

By creating a Worker account, accepting service requests, or clicking "I Agree", you acknowledge that you have read, understood, and agree to be bound by this Agreement.

1. Purpose

HOMZapp is a technology platform that connects customers, real estate professionals, brokerages, and independent service providers.

This Agreement governs your use of the HOMZapp platform as a Worker.

2. Independent Service Provider

You acknowledge and agree that:

  • You are an independent service provider and are not an employee, partner, joint venturer, franchisee, or agent of Qlukapp or HOMZapp.
  • You control how you perform your services.
  • You may accept or decline available jobs, subject to platform rules.
  • You are responsible for your own business operations.

Nothing in this Agreement creates an employment relationship.

3. Eligibility

You represent and warrant that you:

  • Are at least 18 years of age.
  • Have the legal authority to enter into this Agreement.
  • Have all licences, permits, certifications, or qualifications required by applicable law.
  • Will provide accurate and truthful information during registration.

4. Worker Account

You agree to:

  • Maintain accurate profile information.
  • Keep your contact information current.
  • Protect your account credentials.
  • Notify HOMZapp immediately of unauthorized access.

You are responsible for all activities that occur under your account.

5. Accepting Jobs

Workers may receive service requests through HOMZapp.

Once you accept a job, you agree to:

  • Arrive within the agreed service window where reasonably possible.
  • Complete the work professionally.
  • Communicate promptly if delays or issues arise.
  • Follow customer instructions that are lawful and reasonable.

6. Workmanship

You are solely responsible for:

  • The quality of your work.
  • Proper installation or completion of services.
  • Using appropriate materials and equipment.
  • Performing services safely and professionally.

You agree to perform all services using reasonable skill, care, and workmanship.

7. Property Damage

You are solely responsible for any property damage caused by your actions, negligence, or failure to perform services with reasonable care.

Examples include, but are not limited to:

  • Damage to homes or buildings.
  • Damage to lawns or landscaping.
  • Damage to driveways, sidewalks, or fences.
  • Damage to underground utilities or infrastructure.
  • Damage to vehicles.
  • Damage to signs or customer property.

You agree to cooperate fully in resolving any claims arising from your work.

8. Insurance

You are responsible for obtaining and maintaining any insurance required by applicable law for the services you provide.

Where requested by a customer, real estate professional, brokerage, property owner, or other authorized party, you are responsible for providing proof of your insurance coverage directly to the requesting party.

HOMZapp does not verify, manage, or guarantee a Worker's insurance coverage and is not responsible for determining whether a Worker's insurance is adequate for any particular service.

9. Public Safety and Environmental Responsibility

The Worker shall perform all Sign Post installations in a manner that prioritizes the safety of people, animals, property, and the environment.

The Worker is responsible for ensuring that the completed installation does not create a foreseeable safety hazard or unreasonable risk to:

  • Pedestrians or members of the public.
  • Property owners, residents, or visitors.
  • Children.
  • Domestic animals or wildlife.
  • Vehicles using adjacent roads or driveways.
  • Trees, landscaping, gardens, or other natural features.

The Worker shall take reasonable care to ensure that:

  • The sign post is securely installed and stable.
  • No sharp edges, exposed hardware, or hazardous materials are left exposed.
  • The installation does not obstruct sidewalks, driveways, accessibility routes, emergency access, or public rights-of-way.
  • The work area is left clean and free of debris, tools, packaging, or other materials that could cause injury or environmental harm.
  • Installation methods minimize unnecessary disturbance to lawns, gardens, trees, and surrounding landscaping.

If the Worker believes that the requested installation location presents a safety risk or could reasonably cause injury, property damage, or environmental harm, the Worker must not proceed with the installation until the issue has been addressed or an alternative location has been approved.

The Worker is responsible for complying with all applicable laws, municipal by-laws, safety requirements, and environmental regulations relating to the installation of Sign Posts.

Failure to comply with these responsibilities may result in removal from the HOMZapp platform and may subject the Worker to responsibility for any resulting damages, claims, fines, or legal consequences, to the extent permitted by applicable law.

10. Utility Locates and Safe Digging

For services involving ground penetration, including but not limited to Sign Post installation, the Worker is solely responsible for determining whether underground utility locates are required before beginning work.

Where required by law or by the property owner, the Worker must obtain the appropriate utility locate through the applicable Call Before You Dig or underground utility locating service before driving posts, rods, anchors, or other objects into the ground.

The Worker is solely responsible for:

  • Complying with all applicable safe digging laws and regulations.
  • Waiting for required utility locates before commencing work.
  • Avoiding damage to underground utilities and infrastructure.
  • Any loss, damage, injury, penalties, or claims resulting from failure to obtain required utility locates or to follow safe digging practices.

HOMZapp acts solely as a technology platform connecting customers with independent Workers and does not arrange, supervise, or obtain utility locates on behalf of Workers.

11. Property Permission

Before commencing any service, including Sign Post installation, the Worker is responsible for confirming that the service may lawfully proceed at the requested property.

The Worker must make reasonable efforts to verify that:

  • The service location matches the order details provided through HOMZapp.
  • Permission has been granted by the property owner, property manager, listing representative, or other person authorized to approve the work, where such permission is required.
  • There are no visible circumstances indicating that the requested work should not proceed.

If the Worker reasonably believes that permission has not been granted, that the service location is incorrect, or that performing the work may violate applicable laws or the rights of another person, the Worker must suspend the work and promptly notify the customer and HOMZapp before proceeding.

The Worker is solely responsible for any claims, damages, fines, penalties, or legal consequences arising from performing work without the necessary authorization or permission.

HOMZapp provides a technology platform to facilitate service requests and does not verify property ownership, legal authority, easements, municipal approvals, homeowner association approvals, or other permissions required to perform the requested service.

12. Equipment and Vehicles

Unless otherwise agreed in writing, you are responsible for supplying and maintaining your own:

  • Vehicle
  • Tools
  • Equipment
  • Mobile device
  • Internet connection
  • Safety equipment

HOMZapp is not responsible for maintenance, repair, replacement, or operating costs associated with your equipment.

13. Taxes

You are solely responsible for:

  • Income tax reporting.
  • Goods and Services Tax (GST), Harmonized Sales Tax (HST), or other applicable taxes.
  • Canada Pension Plan (CPP) contributions or similar obligations.
  • Any other taxes or government remittances applicable to your business.

HOMZapp does not withhold taxes on your behalf unless required by law.

14. Payments

Payments for completed services will be processed according to HOMZapp's payment procedures.

HOMZapp may deduct:

  • Platform fees where applicable.
  • Refund adjustments where permitted.
  • Chargeback-related adjustments where permitted.
  • Amounts required by law.

Payment schedules may vary depending on the service offered.

15. Customer Conduct

You agree to:

  • Treat customers professionally and respectfully.
  • Avoid abusive, discriminatory, threatening, or inappropriate behaviour.
  • Respect customer privacy.
  • Keep confidential any personal information obtained while performing services.

16. Confidential Information

During your use of HOMZapp, you may receive confidential information relating to customers, brokerages, or HOMZapp.

You agree not to disclose or misuse such information except as necessary to perform the requested services.

This obligation continues after your use of the platform ends.

17. Prohibited Activities

You must not:

  • Submit false information.
  • Misrepresent your qualifications.
  • Commit fraud.
  • Damage customer property intentionally.
  • Harass customers or other users.
  • Circumvent HOMZapp's payment system.
  • Use customer information for unauthorized purposes.
  • Engage in illegal activities while using the platform.

18. Suspension and Termination

HOMZapp may suspend or terminate your account if you:

  • Violate this Agreement.
  • Receive repeated substantiated customer complaints.
  • Engage in fraudulent activity.
  • Fail to maintain required qualifications or insurance.
  • Endanger customers or property.
  • Misuse the HOMZapp platform.

19. Limitation of Liability

To the maximum extent permitted by applicable law, HOMZapp is a technology platform that facilitates connections between customers and independent service providers.

Except where prohibited by law, HOMZapp is not responsible for losses arising from the services you perform.

Nothing in this Agreement limits any rights or obligations that cannot legally be excluded under applicable law.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Qlukapp, HOMZapp, its directors, officers, employees, and affiliates from claims, damages, liabilities, costs, and expenses arising from:

  • Your work or services.
  • Your negligence or misconduct.
  • Damage caused by your actions.
  • Your violation of this Agreement.
  • Your violation of applicable laws.

21. Changes to This Agreement

HOMZapp may update this Agreement from time to time.

Material changes will become effective after notice is provided through the website, mobile application, email, or other reasonable means.

Continued use of the platform after the effective date constitutes acceptance of the updated Agreement.

22. Governing Law

This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, unless another jurisdiction is required by applicable law.

Worker Acknowledgement

By selecting "I Agree", creating a Worker account, or accepting service requests through HOMZapp, you acknowledge that:

  • You have read this Worker Agreement.
  • You understand your rights and responsibilities.
  • You agree to comply with this Agreement.
  • You understand that you are responsible for the services you perform, including the quality of your work and any property damage or loss resulting from your negligence or misconduct, subject to applicable law.
